A driver charged over a fatal crash at Gooram last year, where a Shepparton man died, plans to challenge the charges against him.

Abdul Fatah Faizi, 51, of Shepparton, is charged with dangerous driving causing death, careless driving and driving dangerously.

The charges relate to a single-vehicle crash where the duel-cab ute Mr Faizi was driving left Euroa-Mansfield Rd and went down a 10m embankment near Ridge Rd about 10.15pm on July 9, 2023.

Shepparton man Eid Mohammad Enam Khail, 59, was flown to hospital in a critical condition, where he was later pronounced dead.

Mr Faizi was only charged over the crash on April 27 this year — more than nine months after it occurred.

In court on August 13, Mr Faizi’s defence counsel asked that she be able to cross-examine witnesses in the case — in particular, a passenger about discussions that had been had about conditions of the road and the weather “that related to driving slowly”.

The matter has been set down for a one-day committal hearing in December.

The committal allows Mr Faizi’s defence counsel to test the evidence in the case.
